			<content:encoded><![CDATA[<h1 style="text-align: center;">How do I get off a bail bond?</h1>
<p>This question has come up several times this week. In two cases, the co-signer thought that the bond was too risky. In the third, the defendant turned out to be more stable than the co-signer. How do we deal with this situation?</p>
<p>There are two ways for the co-signer to get off the bond:</p>
<ol>
<li>Revoke the bond and put the defendant back in jail.</li>
<li>Find another co-signer.</li>
</ol>
<p>The co-signer took on a financial responsibility when she co-signed for the bond. That responsibility ends when the bond ends. The bond ends when the court says so or when the bail agent revokes the bond and puts the defendant back in jail. Responsibility continues until the bond is over.</p>
<p>If the co-signer changes her mind, she should call the bail agent and tell him what is going on. The bail agent will want to know if the defendant has become a higher risk and will likely revoke the bond. However, there have been occasions where the defendant turned out to be more stable than the co-signer. In that case, he may permit the defendant the find another co-signer and continue the bond.</p>
<p>You need to discuss this with your bail agent if this situation arises. Only he can help you.</p>

<p>Aaron Avalos was apprehended on 12/22/11. He was taken in to custody without incident and turned over to the Denver Police.</p>
<h2 style="text-align: center;">The Power of the Internet</h2>
<p>The case of Mr. Avalos clearly demonstrates the power of the internet in skip tracing and apprehending fugitives. Within 24 hours of posting Mr. Avalos&#8217; wanted poster, a confidential source called with information regarding his location. My recovery agents and I went to the suspected location and conducted a surveillance of the residence. I was in front and the other agents were at the rear of the house. Children were observed playing in the back yard and were asked if Aaron was home. They replied that he was inside and to just go in.</p>
<p>I went to the front door and asked for Aaron. His brother said that he was not there. However, the recovery agent was at the back door and started in. When the brother saw the other agent, he admitted that Avalos was in the basement. We entered and apprehended Avalos without incident.</p>
<p>I asked Mr. Avalos why he failed to appear in court and he said that his vehicle had been impounded and he did not have a ride to the courthouse. I then asked him why he failed to return my phone calls. He was silent on that issue. He added that he had been talking with his aunt and they had agreed to take care of the matter after Christmas. However, karma waits for no man and the confidential source provided just the information we needed.</p>
<p>My thanks go to the confidential source for providing the information. The source declined the offer of a reward saying that the arrest of Mr. Avalos was reward enough.</p>

			<content:encoded><![CDATA[<p>You might think that a college town like Boulder, Colorado would have smarter criminals. Apparently, that is not the case.</p>
<p>Recently, a Boulder woman reported that her bike was stolen. It had been locked on a rack near Pearl St. She filed a police report that night.</p>
<p>Then next day, she was on Craigslist and saw a bike that looked a lot like hers. She contacted the seller and arranged to meet to look at the bike. She confirmed that the bike was hers and asked the seller for a test ride. He agreed and she rode off&#8230;loaded it in her car and drove home.</p>
<p>Once she recovered her bike, she called police and gave them the information on the suspect. They arrested him at his home a few hours later.</p>

<p>I don&#8217;t remember when I first heard the statement that people do things for their own reasons, not yours. However, it has stuck with me over the years.</p>
<p>The bail business has proven that statement to be true over and over. I&#8217;m constantly amazed by the reasons that people give for not going to court and then I remember that it&#8217;s their reason, not mine.</p>
<p>&nbsp;</p>
<h2 style="text-align: center;">Bail is simple.</h2>
<p>From my perspective, bail is a very simple arrangement. One person agrees to get the other person out of jail if they agree to go to court. Go to court &#8211; stay out of jail. Don&#8217;t go to court &#8211; risk going back to jail.</p>
<p>&nbsp;</p>
<h2 style="text-align: center;">A Bail Agent can be your best friend &#8211; or your worst enemy.</h2>
<p>Again, I see this as very simple. You don&#8217;t want to screw over the person who gets you out of jail. However, a lot of folks don&#8217;t seem to understand that concept. They don&#8217;t go to court for whatever reason and put their family and their bail bondsman in a bad situation. It seems that they think that the bondsman is not going to go after them. Not true.</p>
<h2 style="text-align: center;">Some reasons I&#8217;ve heard.</h2>
<ol>
<li>I forgot.</li>
<li>I had to work.</li>
<li>The car broke down.</li>
<li>I couldn&#8217;t get a ride.</li>
<li>I couldn&#8217;t find a babysitter.</li>
<li>I didn&#8217;t have the money.</li>
<li>I had a job interview.</li>
<li>I was going to go next week.</li>
<li>I went to the wrong court.</li>
<li>I was in jail.</li>
</ol>
<p>These reasons all seem lame to me. However, they are &#8220;their&#8221; reasons, not mine. Lets examine them.</p>
<ol>
<li>I forgot &#8212; I do not understand this excuse at all. How can you possibly forget a court date when the consequence of doing so is that you go back to jail. It seems so simple. Go to court or go back to jail.</li>
<li>I had to work &#8212; People <strong>do </strong>have to work. I get that. However, you risk going back to jail and losing your job. Work it out with your employer.</li>
<li>The car broke down &#8212; again, that happens. You could have called me or the court and let us know. We understand and sometimes we can work it out.</li>
<li>I couldn&#8217;t get a ride &#8212; the sheriff will be more than happy to give you a ride&#8230;back to jail. Have a plan ahead of time.</li>
<li>I couldn&#8217;t find a babysitter &#8212;plan ahead. Who&#8217;s going to watch the kids if you are in jail?</li>
<li>I didn&#8217;t have the money &#8212; this can only make matters worse. If funds are low, the court will understand and put you on  a payment plan. Ignoring the court date will only cost you more in the long run.</li>
<li>I had a job interview &#8212; plan ahead. Schedule the interview on another day. What is your new employer going to think when your bondsman shows up to take you back to jail?</li>
<li>I was going to go next week &#8212; the court has a docket that is loaded with cases. They have to manage those cases and are not in a position to deal with you when you feel like it. Take your court date seriously.</li>
<li>I went to the wrong court &#8212; you are in too much trouble.</li>
<li>I was in jail&#8212; not an excuse. You are in <strong>way too much </strong>trouble.</li>
</ol>
<div>People do things for their own reasons, not yours. That includes people on bail, the courts and bail agents.</div>

However, he makes frequent trips back to Denver and planned to go to Court.</p>
<p style="text-align: left;">Partida call me saying that he was in the hospital with a bad back and would take care of his court appearances when he got out. That didn&#8217;t happen.</p>
<p style="text-align: left;">Mr. Partida is still believed to be in El Paso, Texas.</p>

<p style="text-align: left;">I went to the website for US Commerce Association and found very little information about who they are. Instead, I learned all about how I could order my award for $179.</p>
<p style="text-align: left;">Who &#8220;gives&#8221; and award and requires the recipient to pay for it? Apparently, US Commerce Association.</p>

He was working as a consultant at a power plant and was taken into custody without incident by my recovery agent with assistance from Deputies of the <a title="Milam County Sheriff" href="http://milamcounty.net/sheriff.html">Milam County Sheriff&#8217;s Department</a>. Mr. Tucker waived extradition and was returned to Denver without incident.</p>
<p>I asked Mr. Tucker why he fled the state and failed to appear in court. He responded that his project in Denver had ended and he went to Texas to seek other projects. While in Texas, he learned of a project in Tucson, AZ. He moved to Tucson and worked there for a few months. He encountered the Tucson Police while driving intoxicated and without a license. He posted a cash bond and failed to appear in court. When Tucson Police attempted to serve an arrest warrant for the failure to appear, Mr. Tucker left Tucson and returned to Texas.</p>
<p>I must admit that I admire Mr. Tucker for his drive, tenacity and positive attitude. As I was walking him in to the Denver Police Department, he continued to negotiate with me to post his bond again. &#8220;I&#8217;m an old man with a professional degree and position. Where am I going to go?&#8221;</p>
